1. Introduction
These Terms & Conditions govern all services provided by MD SOUND PRODUCTIONS, operated by Octavian-Daniel Musetoiu, a sole proprietorship (enskild firma) registered in Sweden. By placing an order, accessing delivered files, or engaging in any communication related to a project, you agree to these Terms & Conditions.
These terms apply to both consumers (B2C) and business clients (B2B), with differences noted where required by Swedish law.
2. Scope of Services
MD SOUND PRODUCTIONS provides digital audio services, including but not limited to:
- Mixing
- Mastering
- Editing
- Audio restoration
- Music Production
- Sound design
- Consulting
- Studio and acoustic advice
2.1 Music Production
Music production services may include original compositions, arrangements, or instrumental creation when agreed.
All services are delivered digitally. No physical products are sold.
MD SOUND PRODUCTIONS also provides creative and digital services, including but not limited to:

- Advertising support and campaign planning
- Social media strategy and content guidance
- Branding and messaging consultation
- Website structure planning and content guidance
- Technical advice for website setup and optimization
- Creative direction for online presence and digital identity
These services may include written content, visual concepts, strategic recommendations, and technical guidance.
Unless otherwise agreed in writing, these services do not include hosting, long‑term maintenance, or ongoing management of third‑party platforms.
3. Ordering & Payment
All orders are placed through the website using WooCommerce and paid securely via Stripe.
Payment must be completed before any work begins.
For B2B clients, invoices may be issued upon request.
For B2C clients, Swedish consumer protection laws apply where relevant.
4. Delivery of Digital Files
Final files are delivered via a download link sent by email.
Delivery times vary depending on the scope of the project and will be communicated clearly before work begins.
Once the download link has been sent, the service is considered delivered.
Download links are active for a limited time. Clients are responsible for downloading and securely storing their files after delivery.
Creative and marketing deliverables may be provided in written form, visual mockups, strategic documents, or digital communication, depending on the nature of the project.
5. Revisions
MD SOUND PRODUCTIONS offers unlimited revisions within reason.
“Within reason” means:
- Revisions must relate to the original project scope.
- Revisions must be based on clear, actionable feedback.
- Revisions cannot include new recordings, new arrangements, or additional production unless agreed separately.
- Excessive or repeated revision cycles that go beyond the original scope may require additional fees.
The goal is always to achieve the best possible result through open communication and collaboration.
6. Client Responsibilities
All project‑related communication must take place through email or other agreed channels. Messages sent to personal social media accounts are not considered official communication.
To ensure a smooth workflow, clients agree to:
- Provide accurate information and clear instructions.
- Supply all necessary audio files in the required format.
- Respond to revision requests and feedback within a reasonable timeframe.
- Communicate respectfully and professionally throughout the project.
If a client fails to provide feedback or disappears during the revision process, MD SOUND PRODUCTIONS cannot be held responsible for delays or dissatisfaction with the final result.
Clients agree to provide timely access to necessary information, brand assets, and platform credentials (where applicable) to enable MD SOUND PRODUCTIONS to perform the agreed services.
7. Refunds & Cancellations
Because all services are custom digital work, the following applies:
7.1 Before work begins
If no work has started, the client may request a cancellation and receive a full refund.
7.2 After work has begun
Once work has started, refunds are not available, except in cases where MD SOUND PRODUCTIONS fails to deliver the agreed service despite reasonable attempts to resolve the issue.
7.3 After delivery
Once the final files or download link have been delivered, no refunds are offered.
7.4 Client participation
Refunds are not offered if:
- The client fails to provide feedback
- The client becomes unresponsive
- The client changes their mind
- The client uses the service to “test” without genuine intent to complete the project
MD SOUND PRODUCTIONS commits to working collaboratively to resolve any issues, but the client must actively participate in the revision process.
8. Intellectual Property
Unless otherwise agreed in writing:
8.1 Client‑Provided Material
The client retains full ownership of all audio files, recordings, stems, and musical content they provide to MD SOUND PRODUCTIONS.
The client confirms that they have the legal right to use and submit all materials for processing.
8.2 Work Performed by MD SOUND PRODUCTIONS
All mixing, mastering, editing, restoration, and technical processing performed by MD SOUND PRODUCTIONS is considered a service, not a transfer of copyright.
Upon full payment, the client receives the right to use the final delivered audio files for their intended purpose.
8.3 Original Music Created by MD SOUND PRODUCTIONS
If MD SOUND PRODUCTIONS composes or creates original musical content — including but not limited to:
- instrumentals
- beats
- melody lines
- arrangements
- harmonic structures
- sound design elements
- original compositions
— then MD SOUND PRODUCTIONS retains full copyright to this musical material unless a separate written agreement states otherwise.
The client receives a license to use the music, which may be:
- non‑exclusive, or
- exclusive,
depending on what was agreed at the time of purchase.
8.4 Licensing Terms
Unless explicitly stated:
- Music production services include a non‑exclusive license for the client to use the composition in their project.
- Exclusive rights must be negotiated separately and confirmed in writing.
- MD SOUND PRODUCTIONS may continue to use the musical material for portfolio, promotional, or demonstration purposes unless exclusive rights have been purchased.
8.5 Portfolio Use
MD SOUND PRODUCTIONS may request permission to use short excerpts of completed work for promotional purposes.
The client may decline this request.
8.6 Original Creative Content for Marketing & Web Services
When MD SOUND PRODUCTIONS creates original creative content — including but not limited to:
- advertising concepts
- marketing copy
- taglines and slogans
- social media content plans
- branding recommendations
- website structure or layout suggestions
- UX or content flow concepts
— MD SOUND PRODUCTIONS retains copyright to this material unless a separate written agreement states otherwise.
Upon full payment, the client receives a license to use the delivered creative content for their intended project. This license does not include the right to resell, redistribute, or sublicense the material unless explicitly agreed. If the client requires full ownership or exclusive rights, this must be negotiated separately.
9. Limitation of Liability
MD SOUND PRODUCTIONS is not liable for:
- Loss of data
- Loss of revenue
- Indirect or consequential damages
- Issues caused by client-provided files (e.g., corrupted, poorly recorded, or incomplete material)
- Outages, changes, or limitations imposed by third‑party platforms such as social media networks, hosting providers, or website builders
Liability is limited to the amount paid for the specific service.
MD SOUND PRODUCTIONS does not guarantee specific marketing outcomes, audience growth, engagement levels, or sales results.
All strategic recommendations are provided in good faith based on professional experience.
10. Privacy & Data Handling
Personal data is handled in accordance with the Privacy Policy available on this website.
Client files are stored securely and never shared with third parties except as required for service delivery.
11. Governing Law
These Terms & Conditions are governed by Swedish law.
Any disputes shall be resolved by Swedish courts, with Jönköping as the primary jurisdiction unless otherwise required by consumer protection regulations.
